Terms & Conditions

1. Acceptance

By installing AutoNewsletterAI on your e-commerce platform (OpenCart, WordPress + WooCommerce, PrestaShop, or Shopify), creating an account at autonewsai.com, or using any part of the AutoNewsletterAI service, you agree to these Terms & Conditions. If you do not agree, do not use the service.

2. The service

AutoNewsletterAI ("we", "us", "the service") provides a plugin / SaaS application that reads customer, order and product data from your e-commerce store and uses third-party large language models (currently GPT-4.1-mini and GPT-5 via the OpenAI API) to generate individualized newsletter emails for your customers. The generated content is rendered in your store's admin and sent via the SMTP relay you configure.

3. Eligibility & account

  • You must be at least 18 years old and legally able to enter into contracts.
  • You are responsible for keeping your AutoNewsletterAI account credentials confidential.
  • One account may be used across all supported platforms — quota and plan limits are shared across them.
  • We may suspend or close accounts that violate these Terms or the Acceptable Use rules below.

4. Plans, billing & cancellation

  • Paid plans are billed monthly via Stripe at the price displayed on the Pricing page on the date of upgrade.
  • Generation quotas reset on the 1st of each calendar month at 00:00 UTC. Unused generations do not roll over.
  • You can cancel any time from the in-store Account tab. Your subscription remains active until the end of the paid period; we do not pro-rate refunds for partial months.
  • If a generation request fails with a 4xx or 5xx error, it does not consume quota.
  • Free-tier accounts are permanent. No payment information is required to use the Free tier.

5. Acceptable use

You may not use AutoNewsletterAI to generate or send:

  • Spam, unsolicited bulk email, or email to recipients who have not opted in to your store's communications.
  • Phishing, fraud, deceptive content, or content impersonating another business or individual.
  • Content that violates applicable laws including CAN-SPAM (US), CASL (Canada), GDPR (EU/EEA), or any equivalent anti-spam, consumer-protection or data-protection regulation in your jurisdiction.
  • Hateful, harassing, sexually explicit, or otherwise harmful content.
  • Attempts to reverse-engineer, decompile, or interfere with the service's operation, scrape our content, or circumvent quota / model-access enforcement.

You alone are responsible for the lawful basis for emailing your recipients and for honoring opt-out and unsubscribe requests.

6. Generated content & intellectual property

Subject to your compliance with these Terms, you own the email content generated by AutoNewsletterAI for your store. You may use it, edit it, send it, and incorporate it into your marketing freely.

AutoNewsletterAI, the plugin source code, the website, the brand, and any improvements we make to the service remain our intellectual property and that of our licensors.

7. Email delivery & sender reputation

AutoNewsletterAI does not operate an outbound mail relay. You must configure your own SMTP credentials (via your hosting provider, Postmark, SendGrid, Amazon SES, your shop's existing mail config, etc.). You are solely responsible for:

  • The deliverability and reputation of your sending domain and IP.
  • SPF, DKIM, and DMARC configuration for your sending domain.
  • Compliance with your SMTP provider's Acceptable Use Policy.
  • Honoring bounces, complaints, and unsubscribe requests.

8. Third-party platforms

AutoNewsletterAI integrates with OpenCart, WordPress + WooCommerce, PrestaShop and Shopify. We do not operate these platforms, and we are not responsible for outages, breaking changes, or data loss that occur on them. If your platform vendor's policies conflict with our service, you must follow their policies.

9. Third-party AI & payment providers

The generation engine uses the OpenAI API. By using AutoNewsletterAI you also agree to OpenAI's then-current policies as they apply to content generation. Payment processing is handled by Stripe under their terms.

10. Service availability

We aim for high availability but do not guarantee uninterrupted service. Generation latency, third-party provider outages, planned maintenance, and force-majeure events may cause delays or temporary unavailability. AutoNewsletterAI is provided on an "as-is" basis without warranty of any kind, express or implied.

11. Limitation of liability

To the maximum extent permitted by law, AutoNewsletterAI's total liability arising out of or related to the service is limited to the amount you paid for the service in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages including lost profits, lost revenue, lost data, or reputational harm.

12. Termination

You may stop using the service and uninstall the plugin at any time. We may suspend or terminate accounts that violate these Terms, abuse the service, or fail to pay charges due. On termination, your access ends but sections that by their nature survive (IP ownership, liability limits, indemnities) remain in effect.

13. Changes to these Terms

We may update these Terms when the service changes. Material changes will be announced on autonewsai.com and, for active subscribers, by email. Continued use after the effective date of an update constitutes acceptance.

14. Governing law & contact

These Terms are governed by the laws of the European Union and the country in which the entity operating AutoNewsletterAI is registered. Any dispute will first be addressed by good-faith negotiation; failing that, the competent courts of that jurisdiction have exclusive jurisdiction.
